This is a secure, legal mechanism where a Mexican bank holds the legal title on your behalf, granting you all the rights of ownership, including the ability to occupy, rent, sell, or pass the property down to heirs. It is the standard, safe practice for foreign ownership in coastal areas like Bahía de Banderas.

Closing costs are generally paid by the buyer and typically range between 5% and 8% of the purchase price. This covers various mandatory fees, including the Acquisition Tax (Impuesto de Adquisición), Notary fees, registry fees, and the cost to establish the Fideicomiso. It is essential to budget for these costs in addition to the property price.

In Mexico, the Notario Público is a highly trained, government-appointed attorney who acts as the official legal closing agent. Their role is mandatory and crucial: they ensure the legal validity of the transaction, verify all documents, collect all taxes and fees, and register the new deed with the Public Registry.
